Welcome to Myofect (“Myofect,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, https://myofect.com (the “Site”), and any products, content, features, or services we provide (collectively, the “Services”).

By accessing or using the Site or purchasing from us, you agree to be bound by these Terms and our Privacy Policy and Return & Refund Policy (collectively, the “Agreement”). If you do not agree, please do not use our Site or purchase our products.

1. Eligibility

By using the Site, you represent and warrant that:

3. Orders, Payments & Billing

3.1 Product Orders

By placing an order, you:

  • Agree that all information you provide is accurate and complete

  • Authorize us (and our third-party payment processors) to charge your chosen payment method for the total amount of your order (including taxes, shipping, and any applicable fees)

All orders are subject to acceptance and availability. We may limit or cancel quantities purchased per person, per household, or per order at our sole discretion.

3.2 Pricing & Promotions

Prices and promotions are subject to change without notice. We do our best to display accurate price information but errors may occur. If we discover a pricing or promotional error, we may cancel the order or contact you to confirm whether you wish to proceed at the correct price.

3.3 Taxes

You are responsible for any applicable sales, use, VAT, or other taxes associated with your purchase, as required by law.

4. Shipping, Returns & Refunds

4.1 Shipping

We will make reasonable efforts to fulfill orders promptly, but shipping times are estimates only and not guaranteed. Risk of loss passes to you upon delivery by the carrier.

4.2 Returns & Refunds

Because Myofect products are ingestible, we must follow strict safety rules. Please refer to our full Return & Refund Policy for details. In summary:

  • Returns are accepted within 30 days of delivery

  • Products must be unopened, unused, and in original packaging

  • We do not accept returns on any opened product

  • Customers are typically responsible for return shipping, unless the return is due to our error

We reserve the right to refuse returns that do not comply with our policies.

5. Use of the Site & Prohibited Conduct

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law or regulation

  • Infringe or violate the intellectual property or privacy rights of others

  • Attempt to gain unauthorized access to any systems, accounts, or data

  • Interfere with or disrupt the integrity or performance of the Site

  • Use bots, scrapers, or other automated means to access any part of the Site without our prior permission

  • Upload or transmit any viruses, malware, or harmful code

  • Use the Site for fraudulent, deceptive, or misleading purposes

We may investigate and take any appropriate action (including account suspension or termination) for violations of this section.

6. Intellectual Property

All content on the Site—including text, graphics, logos, product images, videos, recipes, designs, and software—is owned by Myofect or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only. You may not:

  • Copy, reproduce, distribute, modify, or create derivative works from the Site or its content

  • Use any trademarks, logos, or branding without our prior written consent

7. User Content (Reviews, Comments & Submissions)

You may be able to post reviews, comments, photos, recipes, or other content (“User Content”) on the Site or our social channels.

By submitting User Content, you:

  • Represent and warrant that you own or have all necessary rights to the content

  • Grant Myofect a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform the content in any media

We reserve the right (but have no obligation) to remove or edit User Content at our sole discretion.

You may not submit User Content that is illegal, defamatory, harassing, hateful, obscene, misleading, or infringes on any third-party rights.

8. Health & Medical Disclaimer

Myofect products are dietary supplements and food products, not drugs or medical treatments.

  • Statements about our products have not been evaluated by the Food and Drug Administration (FDA).

  • Our products are not intended to diagnose, treat, cure, or prevent any disease.

  • Information on the Site (including recipes, nutrition content, blog posts, videos, and social content) is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult your physician or a qualified healthcare professional:

  • Before starting any new supplement, nutrition regimen, or training program

  • If you are pregnant, nursing, taking medications, or have any medical condition

Never disregard professional medical advice or delay seeking it because of something you read or saw on our Site or channels.

9. No Warranty

11. Indemnification

You agree to indemnify, defend, and hold harmless Myofect and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or products

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property or privacy rights

  • Any User Content you submit

12. Third-Party Links & Services

The Site may contain links to third-party websites or services that are not owned or controlled by Myofect. We are not responsible for the content, policies, or practices of those third parties. Accessing any third-party website is at your own risk and subject to that site’s own terms and policies.

13. Changes to the Site & Terms

We may modify or discontinue any part of the Site or Services at any time, with or without notice.

We may also update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Site after any changes means you accept the updated Terms.

14. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of [STATE], USA, without regard to its conflict of law principles.

  • Entire Agreement: These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Myofect.

  • Severability: If any provision is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  • No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
